Kaka huyo amesisitiza kwamba wanaume wasipate tabu ya kumuuliza dada yake kuhusu suala la ndoa kwani watajisumbua bure.
Juma alizungumza kwa niaba ya dada yake ambaye awali alipigiwa simu ili kuulizwa kama alikuwa na mpango wa kufunga ndoa nyingine hapa nchini.

Hata hivyo, Wastara alimwachia kaka yake huyo kujibu badala yake, ingawaje kaka huyo hakufafanua kama dada yake ameshapata mtu wa kufunga naye ndoa huko Uarabuni.

Wastara alifunga ndoa tatu na wanaume tofauti na mume wake wa mwisho alikuwa msanii wa filamu, Juma Juma Kilowoko ‘Sajuki’ aliyefariki dunia mapema mwaka huu.

Top 10 cities for car thefts

In 1964, California crooners the Beach Boys sang about having "fun, fun, fun, 'til her daddy takes the T-bird away." Well, nearly 50 years later, Golden State residents still have to worry about someone snatching their ride from them — but it's not their daddy. The Des Plaines, Ill.-based National Insurance Crime Bureau has released its "Hot Spots" vehicle-theft report for 2012, and California once again dominates as a "hotbed for hot cars."

Of the top 10 hot spots for per-capita vehicle theft, California lays claim to eight, and the state of Washington to the balance. The NICB's list reviews vehicle thefts from the nation's metropolitan statistical areas; its data mirrors preliminary FBI vehicle-theft data for the same period. While there's nothing new in West Coast domination of the list, this year is special in that the 1.3% spike is the first annual increase following an eight-year downward trend in the crime, the NICB reported. The FBI will publish its final numbers in the fall.

The designated West region — composed of Alaska, Arizona, California, Colorado, Hawaii, Idaho, Montana, Nevada, New Mexico, Oregon, Utah, Washington and Wyoming — in 2012 experienced a 10.6% increase in vehicle thefts compared with 2011, bringing the entire nation's average up despite declines elsewhere. The Midwest, Northeast and South reported reductions of 3.1%, 7.9% and 2.9%, respectively.

Last year's second-place finisher, Modesto, Calif., wrested control of the No. 1 spot from Fresno, Calif., knocking it down one spot; Modesto had 4,260 thefts for a rate of 816.52 per 100,000 population, while Fresno had 7,563 thefts but a lower rate of 797.87 due to its greater population. Newcomers to this year's list are the San Jose-Sunnyvale-Santa Clara, Calif., area at No. 7, up from No. 20 last year, as well as Redding, Calif., all the way up to No. 10 from No. 40 in 2011. The Midland, Mich., and Kahului-Wailuku-Lahaina, Hawaii, areas boasted the fewest car thefts, with fewer than 20 each and a rate of less than 22.

The NICB advises motorists to take precautions against vehicle theft starting with common-sense measures like removing keys from the ignition, locking doors and closing windows, and parking in well-lit areas. Beyond that, bigger and better anti-theft measures include installing a warning device such as a car alarm, using immobilizing devices such as a smart key or fuse cutoffs and using a tracking device that emits a signal to authorities if the vehicle is stolen.

Just as the summer heat comes on strong in June then dwindles by Labor Day, so too can summer romances. Though many summer breakups are laden with heartache, others will have a slightly less dramatic (and sometimes, even a surprisingly happy) ending. He started out seeing one sister, but married the other
“About five years ago, I met Sara at a Memorial Day barbecue and we began going out. We had fun together — I wasn’t sure it was anything that was heading us towards marriage, but I had a good time with her, regardless. She must have felt the same way too, because a few weeks into our dating, she said, ‘You know, you’re a great guy, and at the risk of sounding totally weird, I think you would really hit it off with my sister, Kathy.’ Even though the rejection stung a little, I said I was up for meeting her sister. Good thing I did — Sara was the maid of honor when Kathy and I got married.”

We began dating soon after that, and then got married a few years ago — and now we have a kid together!”

Their post-graduation split spawned a lifelong friendship
“My law school boyfriend and I had a really nice relationship, but there was not much passion there. More than anything, we were best friends. I think we both realized it, and we broke up during the summer after graduation. It was harder than I thought; I missed him so much, even though I knew it was the right thing to do. A couple of nights after we broke up, he called and said: ‘I just broke up with my girlfriend and I am feeling so sad. I wanted to call and speak with my best friend about it.’ I told him that I just broke up with my boyfriend, too, and would love to talk to my best friend about it as well. We spent the next few hours on the phone talking about both of our breakups, but it really was as if we were best friends helping each other out. We are both married to other people now, but are still really good friends to this very day.”

With wonderful traditional Italian food and a classy setting it's no wonder this restaurant is a favourite with celebrities and has been feeding some of the world's greatest tennis players since 1969... "No other restaurant has felt like this to me," said Boris Becker of the top joint. The night before the tennis great won Wimbledon at just 17 years old, he ate steak at this restaurant. Andre Agassi went to the restaurant on the eve of winning Wimbledon.



Nobu, Berkley Street, Mayfair

Andy Murray is said to have eaten up to 50 pieces of sushi in one sitting at Nobu, one of London's most fashionable restaurants. He's not the only tennis star to stop off at the famous Japanese eaterie – many other tennis players including Daniela Hantuchova, Ana Ivanovic and Laura Robson are also regulars at Nobu.

Maria Sharapova reportedly loves the sophisticated Zuma restaurant for its tasty Japanese food.

Beyoncé shares touching mother-daughter moment

Beyoncé has given a touching insight into her life as a mum by sharing an adorable picture of her with her daughter Blue Ivy.

In the heartwarming photograph shared on Tumblr, the superstar singer can be seen crouching down in a stunning red tulle dress with her swept up into a high beehive, beaming at her 16-month-old daughter. 

Just the small arm of Blue Ivy can be seen reaching out from her buggy, touching her mum on the tip of her nose with her index finger.
The beautiful snap is a real insight into the mother-daughter relationship that the two share. Beyoncé also posted a pic of her daughter with a jewelled crown on her head, making her baby girl the queen of the show.

According to another picture that the star posted on her tumblr page, a director’s chair isn't the only purchase she has made for her baby daughter. A tiny, adorable gold-coloured tulle dress with a satin ribbon wrapped around the waist was shown on a hanger.


Another cute photo shows Beyoncé trying on a fuschia-coloured child-size high-heel with the velvet straps laced up to her ankle.

Beyoncé and Jay-Z previously said that Blue Ivy would not be without her home comforts while she accompanies her mum around the world. The couple said they planned to take furniture and toys the youngster is familiar with to stop her feeling homesick while on the road.

David Beckham smoulders on front row at Louis Vuitton show

Former footballing star David Beckham made an unexpected appearance at the Louis Vuitton menswear show in Paris on Thursday.

The handsome A-lister caused quite the stir as he arrived at the presentation with his bodyguard – photographers clamoured to get a shot of the star, while fellow attendees craned their necks for a glimpse of the model.

Backstage, he revealed that it was his first fashion show since his wife's last catwalk presentation in February.

He seemed relaxed, posing for pictures with the brand's creative director and his friend Marc Jacobs as well as Vuitton's chief menswear designer Kim Jones.

"Kim's a very clever man and a great guy as well," said David. "Obviously, I've been living in Paris for the last five months and he's looked after me, he's a friend. And I love his stuff."






It was a busy day for David, who then jetted back to London for the launch of the new Breitling flagship store, where he met Hollywood actor John Travolta.

The celeb pair were the guests of honour at the bash, which was held on the lavish New Bond Street in the capital.

The pair seemed pleased to see each other, happily posing for photographs together outside the store. The men laughed as they attempted a variety of poses to show off their Breitling wrist pieces.

John had been at the store since the afternoon, having officially opened the store by cutting the ribbon.

The actor, who is also a qualified pilot, gave onlookers a pleasant surprise as he walked onto the street accompanied by women dressed in flight attendant outfits.
David's appearance comes just a few days after his joint interview with Victoria Beckham in China.

His wife revealed that she thinks her husband could step into Daniel Craig's shoes and become the next James Bond.

"I think you would be really good at acting," she said, before turning to the interviewer and asking, "Don't you think he'd be good at acting?

"I think you should be James Bond! He'd be a good James Bond!"

David, however, didn't appear to share the same confidence in his big screen chances as his wife.

"I have some friends who are actors , Tom Cruise is a very good friends of ours," he said. "But I don't think I have any plans to become an actor. I'm not sure I'd be very good at it!"

Nando's Knifegate Scandal

Nando's steak knife carrying ways kicked off a round of conversation in both the Ruby and Diamond Houses.
Nando sat quietly in a corner after being punished by Big Brother for carrying a weapon to the Channel O party. However, the same can't be said about his opinionated fellow Housemates.
Beverly told Selly "You must go to the Rendezvous Room for your date with Nando with a knife of your own. Clearly, people are walking around the House like we're in the hood. I feel like I'm watching a movie", she said.
Birthday boy Melvin, whose main mission is to spread love and have fun, especially considering that today is his day, was clearly not impressed. "We're here for fun, not to stab people". Annabel seemed more concerned with what might be happening on Big Brother's social pages. "I'm positive Nando and his knife are trending on Twitter right now", she said with a giggle.
Hakeem also weighed in on the issue and seemed to understand where Nando was coming from. "Nando loves knives. He always carries one around and he's never threatened anyone". The Zimbabwean also conceded how shady the whole scene looked because Nando wasn't looking Sulu in the eye. Maria on the other hand came in with an opposing view. "My first impression is that he was scared and he wanted to protect himself. I didn't even know Nando carries knives", she said.
The Housemates seemed to reach a consensus that Nando had carried the knife to the Channel O party, in case Sulu tried to lunge at him, after he spent some time with Selly in the Rendezvous Room and subsequently, in the bedroom.

UCHAGUZI WA ARUSHA WAAHIRISHWA TENA ILI KUIMARISHA HALI YA AMANI NA UTULIVU



TUME ya Taifa ya Uchaguzi (NEC) imeahirisha tena uchaguzi wa madiwani kata nne za Arusha hadi Julai 14 kuruhusu kurejea utulivu baada ya mlipuko wa bomu kwenye mkutano wa kampeni wa Chadema ulioathiri uchaguzi huo wiki iliyopita.
Bomu hilo lilirushwa Juni 15 na mtu asiyejulikana katikati ya mkutano wa Chadema katika viwanja vya Soweto, mjini Arusha na kusababisha vifo vya watu watatu na wengine kujeruhiwa na uchaguzi huo wa Juni 16 kulazimika kuahirishwa.
Baada ya tukio hilo, Msimamizi wa Uchaguzi wa Arusha aliuahirisha hadi Juni 30, lakini jana Mwenyekiti wa NEC, Jaji Damian Lubuva alisema utafanyika Julai.
Kata zinazohusika ni Elerai, Kimandolu, Thani na Kaloleni. Akizungumza na waandishi wa habari, Jaji Lubuva alisema walipotangaza kuwa uchaguzi ungefanyika Juni 30 waliamini kuwa hali ya utulivu na amani ingekuwa imetengemaa.
“Lakini kwa bahati mbaya tumejiridhisha kuwa hali bado inahitaji kuangaliwa kuhakikisha imerejea katika utulivu wake kikamilifu. “Hiyo haimaanishi kuwa ni mbaya, isipokuwa tumeona bado tunahitaji muda wa kama wiki mbili hivi kuona vumbi lililokuwa likitimka limetulia,” Jaji Lubuva alisema.
Kwa mujibu wa Jaji Lubuva, wapiga kura hawapaswi kutekeleza haki yao ya kupiga kura katika wasiwasi hivyo ni wajibu wa Tume kuhakikisha unaondoka na wapiga kura wanatekeleza haki yao kwa amani.
“Tunataka watu wajihisi huru wakati wa kupiga kura, ndiyo maana tumeahirisha uchaguzi wa kata hizo kwa mara nyingine. Wanapokuwa na amani na uhuru wapiga kura wanaweza kuchagua wanayemtaka kwa utaratibu mzuri, vinginevyo, shughuli yote ya kupiga kura inaweza kuharibika,” alisema Lubuva.
Aidha, alitaka wagombea na vyama kutoendeleza kampeni kwa sababu kuahirishwa kwa uchaguzi hakumaanishi kuwaongeza muda wa kujinadi au kutafuta wapiga kura wa kuwaunga mkono.
“Muda wa kupiga kura haujabadilika. Vituo vya kupigia kura havijabadilika na vitafunguliwa saa moja asubuhi na kufungwa saa 10 jioni. 
Waliokuwa katika mstari ndio watakaopiga kura na watakaofika vituoni baada ya muda huo kwisha hawataruhusiwa kupiga kura ili kutoa nafasi ya kura kuhesabiwa,” alisema.
Jaji Lubuva alisema matokeo ya uchaguzi huo mdogo yatatangazwa mapema na taratibu za uchaguzi zitazingatiwa ili kutoa haki kwa wapiga kura na wanaopigiwa kura.
Inadaiwa bomu hilo lililokuwa kwenye mfuko wa plastiki, lilirushwa na mtu asiyejulikana. Waliopoteza maisha katika tukio hilo ni Amir Ally (7), Judith Moshi na Amir Ally.

Aidha, alitaka wagombea na vyama kutoendeleza kampeni kwa sababu kuahirishwa kwa uchaguzi hakumaanishi kuwaongeza muda wa kujinadi au kutafuta wapiga kura wa kuwaunga mkono.
“Muda wa kupiga kura haujabadilika. Vituo vya kupigia kura havijabadilika na vitafunguliwa saa moja asubuhi na kufungwa saa 10 jioni. 
Waliokuwa katika mstari ndio watakaopiga kura na watakaofika vituoni baada ya muda huo kwisha hawataruhusiwa kupiga kura ili kutoa nafasi ya kura kuhesabiwa,” alisema.
Jaji Lubuva alisema matokeo ya uchaguzi huo mdogo yatatangazwa mapema na taratibu za uchaguzi zitazingatiwa ili kutoa haki kwa wapiga kura na wanaopigiwa kura.

Serikali imetoa tamko bungeni kuhusu mauaji ya raia mikononi mwa polisi ikieleza kuwa sheria ya kanuni ya adhabu inaruhusu kutumia nguvu za kadiri hata kiasi cha kusababisha madhara au kifo.



Kauli hiyo imekuja siku chache baada ya Waziri Mkuu, Mizengo Pinda kunukuliwa bungeni akiwataka polisi kuwashughulikia kwa kuwapiga watu wote wanaokaidi kutii sheria.

“…Nasema wapigwe tu, maana tumechoka sasa,” alisema Pinda alipojibu maswali ya papo hapo Alhamisi iliyopita.


Akisoma tamko hilo bungeni jana, Naibu Waziri wa Mambo ya Ndani, Pereira Ame Silima alisema kuwa kifungu cha 18(B) na 18(C) cha Sheria ya Kanuni ya Adhabu kinatoa uwezo kisheria wa kutumia nguvu za kadiri hata ikibidi kiasi cha kusababisha madhara au kifo katika mazingira ya kisheria.


Aliyataja mazingira hayo kuwa ni pamoja na kuokoa uhai wa mtu mwingine, kuzuia madhara makubwa ya mwili yasitokee kwake au kwa mtu mwingine na kumzuia mtu anayetenda tendo ovu la kubaka au kunajisi mtoto au kufanya vitendo kinyume na maumbile.

Pia kumzuia mtu anayevunja nyumba usiku au unyang’anyi wa kutumia silaha au kuchoma nyumba moto au kufanya kitendo chochote kinachohatarisha uhai wa mtu au mali.


Alieleza kuwa Kifungu cha 18 na 18(A) cha Sheria ya Adhabu Sura namba16 iliyofanyiwa mapitio mwaka 2002, kinampa haki mtu yeyote akiwemo askari kujilinda, kumlinda mtu mwingine, kulinda mali yake au mali ya mtu mwingine ikiwemo ya Serikali na taasisi zake, ambayo iko chini ya uangalizi wake kisheria.


Kauli hiyo ya Serikali kuhusu mauaji ya raia mikononi mwa polisi, ilitolewa ikiwa ni ufafanuzi wa jibu la swali la nyongeza lililoulizwa bungeni Mei 28,2013 na Rashir Ally Abdalah (Tumbe-CUF), ambapo Silima alisema mauaji yanayofanywa na askari polisi ni mauaji ya kisheria. 


Kutokana na kauli hiyo, Mbunge wa Wawi, Hamad Rashi Mohammed aliomba mwongozo wa spika kupata ufafanuzi wa kauli hiyo, na jana Silima kutoa kauli ya Serikali kujibu mwongozo huo.

“Ikumbukwe pia kuwa, kifungu cha 29 cha Sheria ya Jeshi la Polisi na Polisi wasaidizi Sura322, pamoja na Kanuni za Kudumu za Utendaji za Jeshi la Polisi Na274, vinampa haki ya kisheria askari polisi kubeba na kutumia silaha za moto ikiwamo bunduki na mabomu katika utekelezaji wa majukumu yake ya kila siku..,”alisema Silima.


Alifafanua kwamba katika kutafsiri sheria, kanuni na taratibu mbalimbali ikiwamo alizozitaja, mahakama katika nyakati tofauti imetoa msimamo wa kisheria juu ya suala hilo.


Akitoa mfano alisema: “Mathalan katika kesi ya Seif Mohamed Senzagala dhidi ya Jamhuri ya mwaka 1994 kama ilivyonukuliwa na Tanzania Law Report ukurasa wa 122, ambapo mshitakiwa (mwomba rufaa) alimjeruhi kwa panga mlalamikaji ambaye alimfuata nyumbani kwake na kuanza kumshambulia.”


Alisema katika kesi hiyo,mahakama ya rufaa pamoja na kuridhia uamuzi wa mahakama ya awali wa kumtia hatiani kwa kutumia nguvu kupita kiasi, ilibainisha kuwa mshtakiwa hakustahili adhabu kwani alitenda kosa lile wakati akijihami dhidi ya mashambulizi toka kwa mlalamikaji.

“Kwa msingi huo, tarehe 28 Mei, 2013 wakati nikijibu swali Na 290, nilitumia maneno ‘mauaji yanayofanywa kisheria’ nikimaanisha mauaji yanayotokea katika mazingira niliyoeleza..,”alisema Silima.

Hata hivyo alisema siyo nia ya Serikali kuhalalisha vitendo vya matumizi mabaya ya silaha ambavyo vinaweza kufanywa na askari wasio waadilifu.

Alibainisha kuwa Jeshi la Polisi litaendelea kutekeleza majukumu yake kwa mujibu wa sheria, kuheshimu haki za raia na kutumia busara kutatua migogoro.

Hata hivyo, Kambi rasmi ya Upinzani Bungeni imelaani kauli ya Serikali kuhusu mauaji ya raia mikononi mwa polisi iliyoitoa jana na kueleza kuwa haikubaliani nayo kwa kuwa inatoa baraka kwa polisi kuendeleza mauaji ya raia.

Akizungumza na mwandishi wetu baada ya kikao cha bunge kuahirishwa, Waziri Kivuli wa Mambo ya Ndani wa kambi hiyo rasmi, Vicent Nyerere alisema kauli hiyo ingekuwa na uthabiti kama askari polisi wangekuwa waadilifu.


“Kauli ingekuwa thabiti kama polisi wangekuwa waadilifu. kabla ya kutoa kauli hiyo, Serikali ilitakiwa kuchuja miongoni mwa askari wa jeshi la polisi, wa ngazi zote na kuwaondoa wasio waaadilifu ndipo wakatoa kauli hiyo wananchi wataielewa Serikali,”alisema Nyerere ambaye pia ni Mbunge wa Musoma Mjini(Chadema).


Kwa upande wake, Mbunge wa Ole, (CUF) Rajab Mbarouk Mohammed akizungumzia kauli hiyo ya Serikali alisema kuwa majibu ya Naibu Waziri wa Mambo ya Ndani, Pereira Ame Silima ni ya kisiasa.


Alisema kwamba kauli hiyo ni mwendelezo wa kauli iliyotolewa Alhamisi iliyopita na Waziri Mkuu,Mizengo Pinda akiwataka pilisi kuwashughulikia kwa kuwapiga watu wote watakaokaidi kutii sheria.


“Hakuna mwenye haki ya kuua, kuua ni kuua tu. Mahakama pekee ndiyo ina haki ya kuhukumu kifo baada ya kumtia hatiani mshtakiwa husika. Lakini kuwa polisi wanafundishwa utii, siyo kuua,”alisema Rajab.

Alifafanua kuwa kazi ya polisi ni kulinda raia na mali zao na kwamba kuruhusiwa kujihami haimaanishi kuua raia.
Nao Wabunge Aeshi Hilaly na Aly Keissy walisema ni vizuri raia wakatii mamlaka iliyopo na kutekeleza utii wa sheria bila shuruti.

Mbunge wa Kilwa Kaskazini, Murtaza Mangungu alisema: “Maoni yangu haki za watuhumiwa lazima ziheshimiwe.”

Rais wa Chama cha Wanasheria Tanganyika, (TLS), Francis Stola alisema hakuna sheria inayompa mamlaka askari polisi kutumia nguvu za ziada ikiwemo kupiga raia pindi anapotekeleza majukumu yake,isipokuwa tu anaweza kutumia nguvu kiasi iwapo raia anayekabiliana naye anaonyesha vitendo vya kukaidi amri ama kuhatarisha usalama.


Stola ambaye alikuwa akitoa ufafanuzi wa kisheria kuhusiana na kauli bungeni alisema kuwa kwa kufuata sheria polisi haruhusiwi kupiga raia. “ Ukisoma sheria hakuna mahala utakuta kuna neno limeandika piga…. Askari polisi anachoweza kufanya ni arrest(kamata) na siyo vinginevyo, hana mamlaka kabisa ya kupiga raia”

Alisema sheria imetamka wazi kuwa kunapojitokeza hali yoyote inayopaswa kdhibitiwa na vikosi vya ulinzi, nguvu inayopaswa kutumika ni ile ya kawaida na kwamba kitendo cha kutumia risasi za moto ama kupiga raia ni ukiukwaji wa sheria za nchi.

Alisema polisi anapaswa kutoa mwongozo kwa raia kumwelekeza jambo la kufanya iwapo kunajitokeza hali ya sintofahamu,lakini hapaswi kutumia nguvu kupita kiasi ikiwemo kuwapiga raia

“ Sheria inasema wazi kwamba panapojitokeza hali yoyote korofi, polisi wanatakiwa kutumia nguvu ya kawaida tu kukabiliana na hali hiyo na wala siyo kutumia silaha za moto… silaha za moto zinaweza kutumika tu iwapo kunajitokeza tukio ambalo linaweza kuhatarisha usalama wa maisha ama mali isipotee” alisema

Kuhusu wananchi kufanya maandamano, rais huyo alisema maandamano ni haki ya msingi ya kila raia,lakini yanafanyika katika utaratibu maalumu. “ maandamano ni haki ya kila raia lakini panapaswa kuwa na utaratibu maalumu…. Kama kunajitokeza maandamano ambayo hayana utaratibu polisi wanapaswa kutumia reasonable force (nguvu ya kawaida) kudhibiti maandamano hayo na wala siyo kutumia nguvu za ziada.

Serikali imetoa tamko bungeni kuhusu mauaji ya raia mikononi mwa polisi ikieleza kuwa sheria ya kanuni ya adhabu inaruhusu kutumia nguvu za kadiri hata kiasi cha kusababisha madhara au kifo.



Kauli hiyo imekuja siku chache baada ya Waziri Mkuu, Mizengo Pinda kunukuliwa bungeni akiwataka polisi kuwashughulikia kwa kuwapiga watu wote wanaokaidi kutii sheria.

“…Nasema wapigwe tu, maana tumechoka sasa,” alisema Pinda alipojibu maswali ya papo hapo Alhamisi iliyopita.


Akisoma tamko hilo bungeni jana, Naibu Waziri wa Mambo ya Ndani, Pereira Ame Silima alisema kuwa kifungu cha 18(B) na 18(C) cha Sheria ya Kanuni ya Adhabu kinatoa uwezo kisheria wa kutumia nguvu za kadiri hata ikibidi kiasi cha kusababisha madhara au kifo katika mazingira ya kisheria.


Aliyataja mazingira hayo kuwa ni pamoja na kuokoa uhai wa mtu mwingine, kuzuia madhara makubwa ya mwili yasitokee kwake au kwa mtu mwingine na kumzuia mtu anayetenda tendo ovu la kubaka au kunajisi mtoto au kufanya vitendo kinyume na maumbile.

Pia kumzuia mtu anayevunja nyumba usiku au unyang’anyi wa kutumia silaha au kuchoma nyumba moto au kufanya kitendo chochote kinachohatarisha uhai wa mtu au mali.


Alieleza kuwa Kifungu cha 18 na 18(A) cha Sheria ya Adhabu Sura namba16 iliyofanyiwa mapitio mwaka 2002, kinampa haki mtu yeyote akiwemo askari kujilinda, kumlinda mtu mwingine, kulinda mali yake au mali ya mtu mwingine ikiwemo ya Serikali na taasisi zake, ambayo iko chini ya uangalizi wake kisheria.


Kauli hiyo ya Serikali kuhusu mauaji ya raia mikononi mwa polisi, ilitolewa ikiwa ni ufafanuzi wa jibu la swali la nyongeza lililoulizwa bungeni Mei 28,2013 na Rashir Ally Abdalah (Tumbe-CUF), ambapo Silima alisema mauaji yanayofanywa na askari polisi ni mauaji ya kisheria. 


Kutokana na kauli hiyo, Mbunge wa Wawi, Hamad Rashi Mohammed aliomba mwongozo wa spika kupata ufafanuzi wa kauli hiyo, na jana Silima kutoa kauli ya Serikali kujibu mwongozo huo.

“Ikumbukwe pia kuwa, kifungu cha 29 cha Sheria ya Jeshi la Polisi na Polisi wasaidizi Sura322, pamoja na Kanuni za Kudumu za Utendaji za Jeshi la Polisi Na274, vinampa haki ya kisheria askari polisi kubeba na kutumia silaha za moto ikiwamo bunduki na mabomu katika utekelezaji wa majukumu yake ya kila siku..,”alisema Silima.


Alifafanua kwamba katika kutafsiri sheria, kanuni na taratibu mbalimbali ikiwamo alizozitaja, mahakama katika nyakati tofauti imetoa msimamo wa kisheria juu ya suala hilo.


Akitoa mfano alisema: “Mathalan katika kesi ya Seif Mohamed Senzagala dhidi ya Jamhuri ya mwaka 1994 kama ilivyonukuliwa na Tanzania Law Report ukurasa wa 122, ambapo mshitakiwa (mwomba rufaa) alimjeruhi kwa panga mlalamikaji ambaye alimfuata nyumbani kwake na kuanza kumshambulia.”


Alisema katika kesi hiyo,mahakama ya rufaa pamoja na kuridhia uamuzi wa mahakama ya awali wa kumtia hatiani kwa kutumia nguvu kupita kiasi, ilibainisha kuwa mshtakiwa hakustahili adhabu kwani alitenda kosa lile wakati akijihami dhidi ya mashambulizi toka kwa mlalamikaji.

“Kwa msingi huo, tarehe 28 Mei, 2013 wakati nikijibu swali Na 290, nilitumia maneno ‘mauaji yanayofanywa kisheria’ nikimaanisha mauaji yanayotokea katika mazingira niliyoeleza..,”alisema Silima.

Hata hivyo alisema siyo nia ya Serikali kuhalalisha vitendo vya matumizi mabaya ya silaha ambavyo vinaweza kufanywa na askari wasio waadilifu.

Alibainisha kuwa Jeshi la Polisi litaendelea kutekeleza majukumu yake kwa mujibu wa sheria, kuheshimu haki za raia na kutumia busara kutatua migogoro.

Hata hivyo, Kambi rasmi ya Upinzani Bungeni imelaani kauli ya Serikali kuhusu mauaji ya raia mikononi mwa polisi iliyoitoa jana na kueleza kuwa haikubaliani nayo kwa kuwa inatoa baraka kwa polisi kuendeleza mauaji ya raia.

Akizungumza na mwandishi wetu baada ya kikao cha bunge kuahirishwa, Waziri Kivuli wa Mambo ya Ndani wa kambi hiyo rasmi, Vicent Nyerere alisema kauli hiyo ingekuwa na uthabiti kama askari polisi wangekuwa waadilifu.


“Kauli ingekuwa thabiti kama polisi wangekuwa waadilifu. kabla ya kutoa kauli hiyo, Serikali ilitakiwa kuchuja miongoni mwa askari wa jeshi la polisi, wa ngazi zote na kuwaondoa wasio waaadilifu ndipo wakatoa kauli hiyo wananchi wataielewa Serikali,”alisema Nyerere ambaye pia ni Mbunge wa Musoma Mjini(Chadema).


Kwa upande wake, Mbunge wa Ole, (CUF) Rajab Mbarouk Mohammed akizungumzia kauli hiyo ya Serikali alisema kuwa majibu ya Naibu Waziri wa Mambo ya Ndani, Pereira Ame Silima ni ya kisiasa.

“Hakuna mwenye haki ya kuua, kuua ni kuua tu. Mahakama pekee ndiyo ina haki ya kuhukumu kifo baada ya kumtia hatiani mshtakiwa husika. Lakini kuwa polisi wanafundishwa utii, siyo kuua,”alisema Rajab.

Askari polisi anachoweza kufanya ni arrest(kamata) na siyo vinginevyo, hana mamlaka kabisa ya kupiga raia”

Alisema sheria imetamka wazi kuwa kunapojitokeza hali yoyote inayopaswa kdhibitiwa na vikosi vya ulinzi, nguvu inayopaswa kutumika ni ile ya kawaida na kwamba kitendo cha kutumia risasi za moto ama kupiga raia ni ukiukwaji wa sheria za nchi.

Alisema polisi anapaswa kutoa mwongozo kwa raia kumwelekeza jambo la kufanya iwapo kunajitokeza hali ya sintofahamu,lakini hapaswi kutumia nguvu kupita kiasi ikiwemo kuwapiga raia

Kuhusu wananchi kufanya maandamano, rais huyo alisema maandamano ni haki ya msingi ya kila raia,lakini yanafanyika katika utaratibu maalumu. “ maandamano ni haki ya kila raia lakini panapaswa kuwa na utaratibu maalumu…. Kama kunajitokeza maandamano ambayo hayana utaratibu polisi wanapaswa kutumia reasonable force (nguvu ya kawaida) kudhibiti maandamano hayo na wala siyo kutumia nguvu za ziada.
